1. Agreement to these terms
These Terms of Service ("Terms") are a contract between you and everymarketday ("we", "us", "platform") governing use of our website, mobile apps, and related services in Nigeria.
By creating an account, posting a list, placing an order, accepting a delivery job, or otherwise using the platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Roles on the platform
You may use everymarketday in one or more roles. Additional rules apply to each role.
- Buyers post shopping lists or purchase from vendor catalog; pay into escrow; confirm delivery or open disputes.
- Vendors operate approved shops, submit offers, fulfil orders, and receive payouts after delivery is confirmed or disputes close.
- Riders accept assigned deliveries, navigate using coordinates provided in-app, and complete handoff using platform tools.
- You must register separately per role and keep profile information accurate.
3. Accounts & eligibility
You must be at least 18 years old and able to form a binding contract under Nigerian law.
You are responsible for safeguarding login credentials and for all activity under your account. Notify us promptly if you suspect unauthorised access.
We may require phone verification, identity checks, or shop verification before enabling payouts, cash-out, or certain features.
4. Marketplace & offers
everymarketday is a reverse marketplace and catalog platform: buyers express demand; vendors respond with offers; buyers select offers and pay through our checkout.
Offer rankings and estimates are provided for convenience — final prices and availability are determined by vendor offers you accept.
Vendor descriptions, photos, and substitutions follow rules shown at list or order level. Vendors must not misrepresent goods or stall location.
5. Payments, escrow & fees
When a buyer pays, funds are held in escrow by or on behalf of everymarketday until release conditions are met — typically buyer confirmation of delivery or expiry of the dispute window without an open dispute.
Platform fees, delivery fees, and payment processing costs are shown before you confirm payment. Wallet top-ups and refunds follow flows described at checkout and in Trust & escrow.
We are not a bank. Balances and payouts are processed through licensed third-party payment partners subject to their terms and Nigerian regulations.
6. Delivery & handoff
Delivery addresses must include a map pin where required so fees and rider navigation reflect real locations.
Riders are independent contractors or partners, not employees of everymarketday. Vendors and riders must comply with traffic, safety, and local market rules.
Where doorstep delivery applies, buyers should share delivery PINs only when goods are received. False confirmation or PIN misuse may affect dispute outcomes.
7. Disputes & refunds
If an order is wrong, incomplete, late, or not delivered, buyers should open a dispute from the order screen while the order remains eligible — not after improperly confirming delivery.
We review disputes using order snapshots, platform records, and submissions from buyers and vendors. Outcomes may include full or partial refunds to the buyer wallet, release to vendors, or other adjustments consistent with policy.
Our dispute decision is final on the platform except where Nigerian law gives you non-waivable rights.
8. Prohibited conduct
- Illegal goods, stolen items, or goods that violate market or health regulations.
- Harassment, threats, or discrimination toward users or staff.
- Circumventing escrow (e.g. asking buyers to pay off-platform to avoid fees).
- Fake accounts, offer manipulation, or coordinated abuse of rankings.
- Interfering with the app, scraping data without permission, or reverse-engineering security controls.
9. Vendor & rider obligations
- Vendors must honour accepted offers, maintain accurate catalog and stock signals, and use approved pickup pins.
- Vendors must not cancel fulfilled obligations without valid reason; repeated failures may lead to suspension.
- Riders must complete assigned jobs in good faith, protect perishable goods, and report issues through in-app tools.
- Payouts to vendors and riders require linked bank accounts and, where applicable, payout PIN and OTP verification.
10. Content & intellectual property
The everymarketday brand, software, and design are owned by us or our licensors. You receive a limited licence to use the service while these Terms apply.
You retain rights to content you upload (e.g. product images, list notes) but grant us a licence to display and process it to operate the marketplace.
11. Suspension & termination
We may suspend or terminate accounts that violate these Terms, pose fraud or safety risk, or are required by law or payment partners.
You may stop using the platform at any time. Open orders, escrow balances, and legal retention may delay full account deletion.
12. Disclaimers & liability
The service is provided on an "as is" and "as available" basis within the limits of Nigerian law. We do not guarantee uninterrupted access or that every vendor or rider will perform perfectly.
To the fullest extent permitted by law, everymarketday is not liable for indirect, incidental, or consequential damages arising from marketplace transactions between users.
Our aggregate liability to you for claims relating to the service is limited to platform fees you paid us in the twelve (12) months before the event giving rise to the claim, except where liability cannot be limited by law.
13. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Courts in Abuja (or as otherwise required by mandatory consumer protections) have jurisdiction over disputes between you and everymarketday that are not resolved through our support process.
14. Changes to these terms
We may update these Terms from time to time. We will post the revised version with a new "Last updated" date. Material changes may be notified by email or in-app notice.
Continued use after changes take effect constitutes acceptance of the updated Terms.
